Whereas it is agreed that:
 

By using this website, purchasing, accessing, or otherwise utilizing services provided by Brand My Stuff (“we,” “our,” or “us”), you (“you,” “client,” or “customer”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use our services.

1. No Refunds or Exchanges

All sales are final. Once an AI request is submitted, system resources (including CPU usage and tokens) are consumed, regardless of the outcome. If the generated content does not meet your expectations, or if an AI workflow fails, no refunds, credits, or exchanges will be provided.

2. Digital Delivery Only

All products and services are delivered digitally. No physical goods are shipped. You are solely responsible for ensuring you have the necessary technology and internet access to receive and use digital products.

3. Account Management and Expiration

Brand My Stuff reserves the right, at its sole discretion, to suspend or terminate any account or membership at any time, without prior notice, if misuse, fraud, or breach of these Terms is suspected.

Accounts with no activity for a period of twelve (12) consecutive months will be considered dormant. Any remaining tokens will automatically expire and cannot be reinstated or refunded.

4. Image and Content Downloads

Images and other AI-generated content are not permanently stored on our servers. It is the client’s sole responsibility to download and securely store generated files immediately after creation. Brand My Stuff will not be liable for any lost, deleted, or inaccessible content.

5. AI Generation Errors

By submitting a request, you acknowledge that AI generation involves complex processes that may occasionally produce errors or fail to return results. If an error occurs and no image or content is delivered, the tokens and system resources used for the request remain consumed. Tokens will not be refunded in the event of failed or incomplete generation, and Brand My Stuff will not be held responsible for undelivered results.

6. Client Responsibility for Use of Content

Brand My Stuff provides tools for AI-generated content creation but does not control or monitor the specific outputs generated. Clients are fully responsible for the use, publication, and distribution of any generated content and ensuring compliance with all applicable laws, regulations, and third-party rights (including intellectual property and privacy). Any damages, claims, or liabilities arising from their use of generated content.

7. Limitation of Liability

To the maximum extent permitted by law, Brand My Stuff, its owners, affiliates, and employees shall not be held liable for any damages, losses, or claims (direct, indirect, incidental, or consequential) arising from or related to the use, misuse, failure, or inability to use the services or content generated.

8. Limitation of Warranties

Our services are provided on an “as is” and “as available” basis. Brand My Stuff makes no warranties, express or implied, regarding the reliability, accuracy, suitability, quality, or availability of the services or any generated content.

We do not warrant that:

  • The services will meet your specific requirements or expectations.

  • The services will be uninterrupted, timely, secure, or error-free.

  • The generated content will be original, legally compliant, or non-infringing.

  • Any defects or inaccuracies will be corrected.

You use the services at your own risk and are solely responsible for evaluating the accuracy, legality, and appropriateness of generated content.

9. Force Majeure

Brand My Stuff shall not be held liable or responsible for any failure, delay, or disruption in the provision of services caused by circumstances beyond our reasonable control. This includes, but is not limited to: acts of God, natural disasters, power outages, internet failures, server downtime, strikes, labor disputes, government actions, wars, or other unforeseen events. In such cases, services may be temporarily suspended or delayed without liability or obligation for refunds, credits, or compensation.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law provisions. Any dispute, claim, or legal proceeding arising out of or relating to these Terms or your use of the services shall be subject to the exclusive jurisdiction of the courts located in Port Elizabeth, and you consent to the personal jurisdiction and venue of such courts.

POPI Act Agreement & Consent Declaration

Whereas it is agreed that:
 

All parties agree that they will comply with POPI regulations and process all the information and/or personal data in respect of the services being rendered in accordance with the said regulation and only for the purpose of providing the Services set out in the agreement to provide services.
 
The company (also called the service provider), all the parties to this agreement, the service provider’s employees and the client’s employees and any subsequent party/parties to this agreement acknowledge and confirm that
 

One or more of the parties to this agreement, will possess and will continue to possess information that may be classified or maybe deemed as private, confidential or as personal information.
Such information may be deemed as the private, confidential or as personal information in so far as it relates to any party to this agreement.
Such information may also be deemed as or considered as private, confidential or as personal information of any third person who may be directly or indirectly associated with this agreement.
 
Further it is acknowledged and agreed by all parties to this agreement, that such private, confidential or as personal information may have value and such information may or may not be in the public domain. For purposes of rendering services on behalf of the client, the service provider and any party associated with this agreement and/or any subsequent or prior agreement that may have been/will be entered into, irrevocably agree that “confidential information” shall also include inter alia and shall mean inter alia:
 

(a) all information of any party which may or may not be marked “confidential,” “restricted,” “proprietary” or with a similar designation;
(b) where applicable, any and all data and business information;
(c) where applicable the parties may have access to data and personal and business information regarding clients, employees, third parties and the like including personal information as defined in POPI regulation; and
(d) trade secrets, confidential knowledge, know-how, technical information, data or other proprietary information relating to the client/service provider or any third party associated with this agreement and (including, without limitation, all products information, technical knowhow, software programs, computer processing systems and techniques employed or used by either party to this agreement and/or their affiliates.
 
All parties irrevocably agree to abide by the terms and conditions as set out in this agreement as well as you agree and acknowledge that all information provided, whether personal or otherwise, may be used and processed by the service provider and such use may include placing such information in the public domain. Further it is specifically agreed that the service provider will use its best endeavours and take all reasonable precautions to ensure that any information provided, is only used for the purposes of the agreement.
 
It is confirmed that by submitting information to the service provider, irrespective as to how such information is submitted, you consent to the collection, collation, processing, and storing of such information and the use and disclosure of such information in accordance with this policy.
